Unislamic distribution of inheritance in Family System and Its Effects

الملخص

The practice of distribution of inheritance was present in the age of  “Jahliya” but it was not based on the principles of  justice and equity. Rather it depended upon the liking and disliking of the dead person who never cared for these principles, But, the religion of Islam built the foundation of distribution of inheritance on the system of justice and in accordance with justice and fairness, it established this unique system of  inheritance based on the key principles of  kinship,  need and distribution of  wealth. It  was these principles  which guaranteed the eradication of cruelty, injustice and of un moderate ways But in modern times, owing to factors like ignorance,  aversion to religion and distance from Shariat, the Muslims  have  begun  to neglect  the most paramount matter of division of  inheritance just like other financial matters. It means the cruelty and un moderate ways related to the distribution of  inheritance which were once  found in the world before the religion of  Islam are still  present in different forms among the Muslims and  are having the fatal effects on the family life. In establishing an ideal society,  the Muslims Ummah,  including  the beloved country Pakistan,  is facing serious problems  and obstacles. In this  research paper, all such types of un islamic  practices and  their  impacts on family life will be examined and different  suggestions will be presented to eradicate  the non-shariat customs regarding the distribution of  inheritance.
